We, as lawyers, are often approached by managers construction companies performing various auxiliary work at construction sites, with one single question: “Does our company have to join the SRO? Can we work without a SRO permit for construction work? Answer - Yes, you can, if you:

1. Build a garage on land plot provided to an individual.
2. Build on the land provided for gardening, dacha farming;
3. Build or Renovate Non-Object Objects capital construction(kiosks, sheds and others);
4. Build facilities and structures for auxiliary use;
5. Change capital construction objects and (or) their parts, but if such changes do not affect the design and other characteristics of their reliability and safety, do not violate the rights of third parties and do not exceed the limit parameters of permitted construction, reconstruction established by the urban planning regulations;
6. Build a detached residential building. The number of floors in it is not more than three. It is designed to accommodate no more than two families;
7. Build a detached residential building. The number of floors in it is not more than three. The house can consist of several blocks, but not more than ten. Each of the blocks is designed for one family. It also has a common wall(s) without openings with the neighboring block(s). The residential building is located on a separate land plot and has access to the territory common use.

  • p.2.4 Installation and dismantling of inventory external and internal scaffolding, technological garbage chutes;
  • p.3.1 Mechanized excavation;
  • p.3.5 Soil compaction with rollers, compactors or heavy rammers;

So these works do not require SRO approval if they are NOT carried out at especially dangerous, technically complex and unique facilities. If the listed works are carried out at especially dangerous, technically complex and unique objects, then the SRO approval is required. 1) facilities using atomic energy (including nuclear installations, storage facilities for nuclear materials and radioactive substances);
2) hydraulic structures of the first and second classes, installed in accordance with the legislation on the safety of hydraulic structures;
3) line-cable communication facilities and communication facilities, determined in accordance with the legislation of the Russian Federation;
4) power lines and other electric grid facilities with a voltage of 330 kilovolts or more;
5) objects of space infrastructure;
6) airports and other aviation infrastructure facilities;
7) infrastructure facilities railway transport common use;
8) subways;
9) seaports, with the exception of sea specialized ports intended for servicing sports and pleasure craft;
10) thermal power plants with a capacity of 150 megawatts and more;
11) dangerous production facilities, where:
* obtained, used, processed, formed, stored, transported, destroyed hazardous substances in quantities exceeding the limit. Such substances and limit quantities of hazardous substances, respectively, are specified in Annexes 1 and 2 to the Federal Law of July 21, 1997 N 116-FZ "On Industrial Safety of Hazardous Production Facilities"
The gas distribution systems used, stored, transported do not belong to especially dangerous and technically complex facilities. natural gas under pressure up to 1.2 megapascal inclusive or liquefied petroleum gas under pressure up to 1.6 megapascal inclusive;
* melts of ferrous and non-ferrous metals and alloys based on these melts are obtained;
* mining, mineral processing, and underground operations are underway;
* permanently installed cable cars and funiculars are used.

The unique objects are :
capital construction projects, project documentation which includes at least one of the following characteristics:
1) height more than 100 meters;
2) spans over 100 meters;
3) the presence of a console more than 20 meters;
4) deepening of the underground part (in whole or in part) below the planning mark of the earth by more than 10 meters;
5) the presence of structures and structural systems for which non-standard calculation methods are applied taking into account physical or geometric non-linear properties or special calculation methods are developed.

If in the lists of work, you did not find those types of work that do not require permission from the SRO, but which you produce, then you need to join the SRO.

The functions of control and management of the construction industry were transferred from government agencies self-regulatory organizations since the beginning of 2010. This was the result of the entry into force of July 2007 No. 315-FZ.

The key provision of the new federal law deservedly considers the introduction of SRO permits for certain types works. Their exhaustive list was established by the Order of the Ministry of Regional Development, issued on December 30, 2009 under No. 624. The system of tolerances formed in this way existed until mid-2017, when it was replaced by a new one, approved by No. 372-FZ.

Types of operating SROs

The above-mentioned Order No. 624, containing a list of works for the production of which it was necessary to obtain an SRO permit, provided for their division into 3 categories. They coincided with the types of self-regulatory organizations created as a result of the introduction of No. 315-FZ, namely:

    construction;

    design;

    engineering survey.

Each type of trade union association issued permits for certain types of SRO work. Therefore, if they wanted to simultaneously carry out surveys, project development, and construction of an object, a market participant had to join three SROs at once.

List of engineering and survey works with SRO approval

Order No. 624 provided for the shortest list of works for trade union associations of surveyors. It included several categories, which were divided according to the types of surveys carried out.

Engineering and geodetic

This group of works contains the most popular and widely used engineering survey. These include:

    Construction of reference geodetic networks used to bind the object.

    Monitoring and control over the condition, amount of shrinkage and the presence of deformations of building structures and parts of buildings, as well as structures in general.

    Calculation of the magnitude of soil movement and determination of the level of danger of such processes.

    Creation, correction and approval of topographic schemes and plans on a scale from 1:200 to 1:5000.

    Carrying out engineering and topographic survey of structures and communications located underground.

    Tracing linear objects both newly built and existing ones.

    Executive topographic and geodetic survey, performed in the process of construction, reconstruction and, if necessary, overhaul.

Geotechnical

The earlier operating rules for the work of survey SROs provided for the issuance of permits for the following types of engineering and geological work:

    Creation of a geo-underlay, the scale of which is in the range from 1:5000 to 1:25000.

    Examination and study of mine workings, including surveys of underground water and soil samples carried out.

    Study of potentially dangerous natural processes that occur in the places of existing mine workings and are of a geological nature. Development of a set of measures aimed at the engineering protection of objects.

    Conducting a variety of research and testing related to hydrogeology, geocryology and geophysics, which are aimed at meeting the needs of various mining industries.

    The study of the seismic characteristics of the area where the construction of industrial facilities is located or planned.

Engineering and hydrometeorological

The purpose of engineering and hydrometeorological surveys is to study and determine the main characteristics and parameters of water bodies located at the site of the proposed construction. These works are quite specific and require appropriate qualifications and training.

Among the most demanded of them are observations and collection of data on the processes occurring in water bodies and related phenomena, as well as the subsequent analysis of the collected information. A separate category includes works related to the study of the ice regime of the area, and in addition, studies of the outlines and ongoing deformations of the coastal territory and coasts.

Engineering and environmental

The name of this category of research eloquently shows their main focus - the study of the environmental properties and characteristics of the area of ​​the proposed construction, as well as predicting the consequences of the operation of the erected facility. Environmental engineering works include the following types research:

    Various types of terrain surveys in order to obtain data on its environmental parameters.

    Realization of full-scale measurements of the state of air, soil, water in order to identify foreign impurities and pollution.

    Collection of samples of soil, air, underground and ground water and their subsequent examination for the presence of pollution, harmful impurities, etc.

    Determination of sources of pollution of natural resources.

    Analysis of the data obtained during the collection of information and forecasting the impact of the construction and operation of the facility on the state environment in terms of ecology.

Geotechnical engineering

A separate category of engineering surveys aimed at studying the properties and parameters of the territory of the proposed construction or the location of existing facilities. To perform such work, it was also required to obtain a permit from a specialized SRO.

Soil research

Surveys, the purpose of which is to collect information about the properties and characteristics of soils in the place of future construction, are deservedly among the most demanded engineering works. This is explained by the fact that the choice of a suitable type of foundation and its design and technological features largely depend on the results obtained.

List of design works with SRO approval

Despite the fact that the full list of works for which it was required to obtain permission from the project SRO is a long and very impressive list, these activities can be divided into several categories. These include:

    Development of FPIC, as well as individual components, including the general plan of the construction site and individual FPICs for capital buildings, structures and linear objects.

    Acceptance and documentary implementation of decisions, constructive and architectural, which are an important and indispensable part of any project.

    Development of separate sections relating to engineering networks, both external and internal.

    Adoption and documentary implementation of technological solutions related to the functional purpose of the building. According to this parameter, structures and buildings are divided into residential, industrial, public, administrative, hydraulic, infrastructure, etc.

    Creation of special sections of project documentation. In this case, we are talking about the development of such documents as an environmental declaration, a fire risk assessment, a set of measures for civil defense, an accident response plan, etc. The list of required documentation is determined by the functional purpose of the object and its operational parameters.

    Inspection of materials, structures, parts and elements of buildings.

List of construction works with SRO approval

The most serious scope of Order No. 624 was the types of work of SROs related to professional associations of builders and requiring admission upon entry into self-regulatory organizations this profile. The most important and largest positions of the list looked like this:

    Geodetic. Produced at the construction site. In fact, they differ little from those described above in the list of engineering and survey works.

    Preparatory. Provide for dismantling of buildings and structures, dismantling of individual structures and parts of buildings. The preparatory work also includes the construction of temporary buildings and facilities, for example. crane runways, camps for workers, inventory scaffolding, etc. Completed prior to commencement of major work.

    Earthy. TO this type include actions for excavation, transportation or movement of soil, as well as activities related to compaction of the earth, freezing or dewatering.

    Drilling of the wells. They include both the installation of a conventional well for water, and the construction of wells for the extraction of energy resources.

    Pile. These are considered to be works not only on the installation of pile foundations, but also on the strengthening of soils, for example, coastal ones.

    Monolithic reinforced concrete and concrete. They represent a long list of various works on pouring concrete into building structures directly on the site. The group also includes preparatory and related work provided for by the technology, for example, formwork, reinforcement, etc.

    Prefabricated reinforced concrete. Contain work on the installation of reinforced concrete structures produced in the factory. This can be a device of various parts and elements of a building, for example, foundations, ceilings and coatings, walls, elevator shafts, etc.

    Drilling and blasting. The purpose of their implementation is the dismantling and dismantling of various structures, when the use of other methods and technologies is inappropriate.

New law on SRO No. 372-FZ

Among the main innovations that came into force after July 1, 2017 and related to No. 372-FZ, is the abolition of SRO permits issued earlier for certain types of work. Therefore, the list established by Order No. 624 is no longer valid.

Today, the obligation to join a specialized SRO is determined by completely different principles and rules. Membership in a professional association is required for those contractors, designers and surveyors who plan to carry out the following activities:

    participation in public procurement, which are carried out according to No. 223-FZ or No. 44-FZ;

    conclusion of direct contracts with investors, developers, organizations involved in the operation of buildings, and technical customers;

    participation in federal programs through cooperation with regional operators;

    signing a work contract or general contract, the cost of work for which is 3 million rubles or more;

    combining the functions of the builder with the performance of work on surveys, design or construction of buildings.

In accordance with the provisions of No. 372-FZ, the following market participants in the construction industry do not need to join the SRO:

    contractors performing work under contracts worth less than 3 million rubles;

    unitary enterprises And commercial organizations owned by the state for half or more;

    individuals engaged in the construction, repair or reconstruction of facilities classified as individual housing construction;

    any companies and individual entrepreneurs engaged in non-capital buildings.

In what cases is a certificate of admission of the SRO in 2018 not needed?

The SRO admission certificate is a document issued by a self-regulatory organization to its member, in accordance with Article 55.8 of the Town Planning Code of the Russian Federation (hereinafter referred to as the Civil Code of the Russian Federation). It is necessary for companies and individual entrepreneurs who plan to produce construction, design and / or survey work for capital buildings. At the same time, the presence of an admission (as well as membership in an SRO) is not necessary for contractors who do not plan to carry out construction work at capital construction facilities.

In order to determine whether permission is required to conduct a particular type of activity, one should be guided by the list of works, which was approved by the order of the Ministry of Regional Development "On Approval ..." dated December 30, 2009 No. 624. If the work planned for execution is not indicated in this list, then the permit for its implementation is not required.

Types of work without SRO permits

It is important to remember that not all buildings under construction are capital. Accordingly, at such facilities, the contractor may have the right to carry out construction or design work without the approval of the SRO. The list of structures, the construction or repair of which does not require a permit, is specified in part 17 of article 51 of the Civil Code of the Russian Federation.

These include:

  1. Building garages for personal use in citizen-owned areas.
  2. Construction of kiosks, sheds, temporary, utility or auxiliary premises that do not have a foundation.
  3. Carrying out work on the reconstruction of capital construction facilities, if this does not entail a threat to their reliability and safety.
  4. Holding repair work at capital construction facilities, with the exception of major repairs.

Exceptions to Order No. 624

Paragraph 2 of the order of the Ministry of Regional Development No. 624 also indicates a list of objects on which work can be performed without an appropriate permit:

  1. Separate and located separately from other buildings, residential buildings intended for the residence of no more than 2 families, having a height of no more than 3 floors.
  2. Multi-block residential buildings no more than 3 floors in height with the following characteristics:
  • the number of blocks - no more than 10;
  • the block is adapted to accommodate 1 family;
  • each of the sections has at least 1 common wall with other blocks.
  1. Multi-block residential buildings with the following allowable parameters:
  • height - no more than 3 floors;
  • the number of block sections in which apartments and auxiliary premises are located is not more than 4, while a separate isolated exit to the courtyard from each section is required.

Design work without SRO approval

When considering the list of permitted design works that do not require a permit, it is important to remember that there is no official list of them by law. However, practice allows the formation of approximate categories of activities that are acceptable, since the work is not explicitly indicated as requiring admission.

These include:

  • marking work on the site when preparing it for construction;
  • geodetic control over measurements;
  • preparation of projects for the dismantling of buildings and structures, the construction of temporary roads, structures, engineering networks, etc.;
  • fencing design;
  • design and installation work on the placement of external communication lines, internal systems air conditioning, fire extinguishing, water supply, sewerage, power supply (up to 1 kW), as well as technological equipment (pumps, automation systems, fans, etc.);
  • creating projects landscape design, decoration, etc.

It is important to remember that this list does not apply to particularly complex or dangerous facilities indicated in Article 48.1 of the Civil Code of the Russian Federation (nuclear power plants, seaports, metro, etc.).

Types of construction work not requiring SRO approval

By analogy with the list of design work, one can also draw up sample list construction, the conduct of which is allowed without membership in the SRO and the appropriate permit.

Among them:

  • dismantling of roads, walls, ceilings, engineering networks, clearing of sites and preparation of areas for construction;
  • conducting land works(both manually and with the use of mechanization), i.e. digging pits, filling soil, strengthening soil, etc.;
  • finishing works, including facing, laying of foundations, retaining walls, partitions;
  • painting and plastering works;
  • work on insulation and waterproofing of buildings;
  • installation of floors, screeds, installation of floor coverings;
  • glazing, installation of engineering systems, communication lines;
  • installation and start internal equipment for building maintenance, etc.

Summing up, it remains to be noted that for practitioners to get an accurate answer to the question of whether a permit is needed to carry out a particular work, it is enough to check the list approved by the order of the Ministry of Regional Development indicated above.
