2) Secondly, work on the preparation of project documentation, construction, reconstruction and overhaul, regardless of whether they are included in the List or not, can be carried out without joining the SRO and obtaining permits in relation to:

objects that are not particularly dangerous, technically complex and unique objects in accordance with Article 48.1 of the Town Planning Code Russian Federation;
building a garage land plot provided by to an individual for purposes other than implementation entrepreneurial activity, or construction on a land plot provided for gardening, dacha farming
construction, reconstruction of objects that are not objects of capital construction (kiosks, sheds, etc.) (Objects for which the issuance of a building permit is not required in accordance with part 17 of article 51 of the Town Planning Code of the Russian Federation);
construction on the land plot of buildings and structures for auxiliary use (Objects for which the issuance of a building permit is not required in accordance with part 17 of article 51 of the Town Planning Code of the Russian Federation);
changes in capital construction objects and (or) their parts, if such changes do not affect the design and other characteristics of their reliability and safety and do not exceed the limit parameters of permitted construction, reconstruction established by the urban planning regulations (Objects for which the issuance of a building permit is not required in accordance with part 17 of article 51 of the Town Planning Code of the Russian Federation);
individual housing construction(detached residential buildings with no more than three floors, intended for no more than two families)
residential buildings with no more than three floors, consisting of several blocks, the number of which does not exceed ten and each of which is intended for one family, has a common wall (common walls) without openings with the neighboring block or neighboring blocks, is located on a separate land plot and has access to the territory common use(residential houses of blocked development) (Clause 2 of the Order of the Ministry of Regional Development of the Russian Federation of December 30, 2009 N 624);
apartment buildings with no more than three floors, consisting of one or more block sections, the number of which does not exceed four, each of which contains several apartments and common areas and each of which has a separate entrance with access to the common area (Clause 2 of the Order of the Ministry of Regional Development of the Russian Federation of December 30, 2009 N 624)
detached capital construction facilities with no more than two floors, the total area of which is not more than 1500 sq.m., and which are not intended for citizens to live and carry out production activities, with the exception of objects that are especially dangerous, technically complex or unique objects (Art. 49 p. 2.4 No. 190-FZ "Urban Planning Code of the Russian Federation" dated December 29, 2004);
free-standing capital construction projects with no more than two floors, the total area of which is not more than 1500 square meters, which are intended for the implementation of production activities, and for which the establishment of sanitary protection zones is not required, or for which within the boundaries land plots where such facilities are located, sanitary protection zones have been established or the establishment of such zones is required, with the exception of facilities that are especially dangerous, technically complex or unique facilities (Art. 49 p. 2.5 No. 190-FZ "Urban Planning Code of the Russian Federation" dated December 29, 2004).

First of all, it is necessary to understand what an SRO is and why SROs are needed at all (we remind you that in this article we are talking mainly about construction SROs). SRO is an abbreviation for self-regulatory organization. A self-regulatory organization is non-profit organization, details of which are included in State Register self-regulatory organizations of a certain type, and which is an association of business entities of one industry or business entities professional activity of a certain type, which, in fact, are its members with absolutely equal rights and obligations.

Thus, SRO is an association of legal entities and individual entrepreneurs, employed, for example, in the construction industry, and pursuing common goals. The objectives of the self-regulatory organization in the field of engineering surveys, architectural and construction design, construction, are indicated in Article 55.1 of the Town Planning Code of the Russian Federation and boil down to improving the quality of work performed, preventing damage to life, health and property and acting as a guarantor of the fulfillment of obligations of its members under contracts and tenders.

To improve the quality and safety level of the work carried out, the SRO apparatus, through periodic inspections, monitors the compliance of its members with the requirements for equipment, specialists and other indicators (the requirements are established by the NPA of the Russian Federation and local acts of the SRO, mandatory for all its members). 1. If the amount of obligations under the contract in which you are the executor does not exceed three million rubles;

objects of individual housing construction (for example, a detached residential building not higher than three floors);
objects that are not objects of capital construction (for example, a temporary building, a canopy);
buildings and structures for auxiliary use (for example, a greenhouse).

7. Build a detached residential building. The number of floors in it is not more than three. The house can consist of several blocks, but not more than ten. Each of the blocks is designed for one family. It also has a common wall(s) without openings with the neighboring block(s). The residential building is located on a separate land plot and has access to the common area.

11) dangerous production facilities, where:
* obtained, used, processed, formed, stored, transported, destroyed hazardous substances in quantities exceeding the limit. Such substances and limit quantities of hazardous substances are specified in annexes 1 and 2 to federal law dated July 21, 1997 N 116-FZ "On the industrial safety of hazardous production facilities"
Gas distribution systems that use, store, transport natural gas under pressure up to 1.2 megapascal inclusive or liquefied hydrocarbon gas under pressure up to 1.6 megapascal inclusive do not belong to especially dangerous and technically complex facilities;
* melts of ferrous and non-ferrous metals and alloys based on these melts are obtained;
* mining, mineral processing, and underground operations are underway;
* permanently installed cable cars and funiculars are used.

The unique objects are :
capital construction projects, the project documentation of which provides for at least one of the following characteristics:
1) height more than 100 meters;
2) spans over 100 meters;
3) the presence of a console more than 20 meters;
4) deepening of the underground part (in whole or in part) below the planning mark of the earth by more than 10 meters;
5) the presence of structures and structural systems for which non-standard calculation methods are applied taking into account physical or geometric non-linear properties or special calculation methods are developed.

If in the lists of work, you did not find those types of work that do not require permission from the SRO, but which you produce, then you need to join the SRO.

SRO approval is not required:

1. UNLESS A CONSTRUCTION PERMIT IS REQUIRED.

Construction, reconstruction, overhaul works are carried out in relation to objects where the issuance of a building permit is not required in accordance with paragraphs 1 - 4, 5 of part 17 of article 51 of the Town Planning Code of the Russian Federation.

If a company performs construction work at facilities for which it is not necessary to obtain a building permit, then, accordingly, to perform construction works SRO approval is not required for these facilities.

Which construction sites do not require a building permit and, as a result, do not require SRO approval?

A building permit is not required if:

a) construction of a garage on a land plot provided to an individual for purposes not related to entrepreneurial activities, or construction of a dacha economy on a land plot provided for gardening;

b) construction, reconstruction of objects that are not objects of capital construction (kiosks, sheds, trailers and others);

c) construction on the land plot of buildings and structures for auxiliary use;

d) changes in capital construction objects and (or) their parts, if such changes do not affect the design and other characteristics of their reliability and safety and do not exceed the limit parameters of permitted construction, reconstruction established by the urban planning regulations;

e) in other cases, if, in accordance with the Town Planning Code, the legislation of the constituent entities of the Russian Federation on town planning activities, obtaining a building permit is not required.

So, if a construction company performs the above works at facilities where it is not necessary to obtain a building permit, then there is no need to join an SRO and obtain a permit for construction work.

2. FOR LOW-STORY CONSTRUCTION:

1. In relation to objects of individual housing construction (detached residential buildings with no more than three floors, intended for no more than two families);

2. In relation to residential buildings with no more than three floors, consisting of several blocks, where their number does not exceed ten and each is intended for one family, has a common wall (common walls) without openings with the neighboring block or neighboring blocks, located on a separate land plot and has access to a common area (residential houses of blocked development);

3. In relation to apartment buildings with no more than three floors, consisting of one or more block sections, the number of which does not exceed four, each of which contains several apartments and common areas and each of which has a separate entrance with access to common area.

* However, according to the Town Planning Code of Russia and the classifier of works, objects with a certain roofing (roofing) are removed from low-rise construction, which does not require SRO approval:

in the form of ribbed-ring and ribbed domes,
shells of double curvature,
mesh domes,
membrane coatings,
hanging structures,
coverings from glued wood elements, including crossbars, arches, frames.

3. FOR CERTAIN TYPES OF WORKS CARRIED OUT AT CAPITAL CONSTRUCTION OBJECTS NOT RELATED TO ESPECIALLY DANGEROUS, TECHNICALLY COMPLEX AND UNIQUE

ATTENTION:

However, in some situations, construction companies that perform work that does not require SRO approval have to join SROs. This, as a rule, concerns companies that have a "finicky" customer or participate in tenders. Organizers of tenders and similar customers in the vast majority of cases set for participants required condition– membership in the SRO, even if the work is performed at facilities that do not provide for mandatory entry into the SRO. In this case, the organizers of tenders can be understood, since their property interests are more protected when working with construction company member of an SRO than when working with builders who have not joined a self-regulatory organization.

Below is a list of works for which a permit is not required in the preparation of project documentation, as well as engineering surveys:

Construction of a garage on a land plot provided to an individual for possession or long-term lease for non-commercial purposes and entrepreneurial activities. It can also be the construction of dacha facilities and gardening;
Construction of sheds, kiosks, as well as other objects that do not belong to the category of capital construction objects and do not require the issuance of a permit for construction and design work;
Erection of auxiliary buildings (in accordance with Article 51 of the Town Planning Code of the Russian Federation on objects that do not require obtaining permits for design and construction work);
Reconstruction and repair of capital construction objects, as well as their elements. Changes should not affect the design and other characteristics of reliability, safety, exceed the maximum allowable parameters of permitted construction, reconstruction, established Urban Planning Code;
In other cases, according to the Civil Code of the Russian Federation, the legislation of the constituent entities of the Russian Federation on urban planning does not require a permit for construction and design work;
Objects of individual housing construction (detached residential buildings, where the number of floors does not exceed 3). Such houses can be intended for no more than two families (according to the Order of the Ministry of Regional Development of the Russian Federation);
Residential buildings, where the number of storeys does not exceed 3. Such houses can consist of several blocks (there can be no more than 10 and each is intended for one family). Such a structure may have common walls with a neighboring house without openings or adjacent blocks. It must be located on a separate land plot, have access to a territory intended for common use (residential buildings of a blocked building);
Apartment buildings where the number of floors does not exceed three. The house may consist of several block-sections or one, the total number should not exceed 4. Each block may contain several apartments, public premises, an entrance with access to the common area.

List of works for which a design permit is not required

Below is a list of works that do not affect safety, which means that when designing, you do not need to obtain a self-regulatory partnership permit:

Training internal systems power supply;
Low current systems;
Preparation of projects for the organization of construction, service life extension, conservation, demolition, dismantling of structures and buildings;
Works in the field landscape design and landscape design;
Design of projects of structures and interiors of buildings;
Drawing up estimates for construction, survey, design work. Maintenance of budget documentation;
Geodetic monitoring of deformations and settlement of structures and buildings, movements of the earth's surface, hazardous natural processes;
topographic, geodetic works in the field of reconstruction of buildings and structures, as well as construction;
Study of the state, composition of soils under standing buildings and structures.

When is a permit required?

If the project company performs the work included in the List approved by the Order of the Ministry of Regional Development, a certificate of admission to carry out design work must be obtained without fail. Ignoring this rule may result in a security breach that will result in administrative penalties and, in severe cases, criminal liability.

This list contains the names of design works, works related to the reconstruction and overhaul. In order to start implementing them, you need to enter into a self-regulatory partnership and obtain the appropriate certificate - a work permit. The permission is indefinite.

Separate types works in the presented list are marked as "*", which means the need to obtain permits when carrying out works belonging to the category of unique, dangerous and technically complex. So, from a technical point of view, especially dangerous and complex objects are the following:

communication facilities belonging to the category of technically complex, especially dangerous according to Russian legislation;
subways;
hydrotechnical objects of the first and second class, installed in accordance with the legislative norms for the safety of hydraulic structures;
seaports, except for special ports established for servicing recreational and sporting vessels;
nuclear facilities, which include storage facilities for radioactive substances, waste and nuclear materials;
power grid facilities and power lines (voltage above 330 kilovolts;
objects of aviation and space infrastructure;
thermal power plants (with a capacity of 150 megawatts or more);
hazardous production facilities where the creation, processing, use, storage, transportation, destruction of an exorbitant amount of hazardous substances takes place. Substances are described in detail in Annexes 1 and 2 to the Federal Law N 116-FZ on industrial safety of hazardous production facilities.

It should be noted that technically complex and dangerous objects do not belong to:

gas distribution systems for the use, storage, transportation natural gas under a pressure of 1.2 megapascals, including liquefied petroleum gas under a pressure of not more than 1.6 MPa.
facilities where ferrous and non-ferrous alloys are produced, mining and underground operations are carried out, and mineral processing operations are carried out.

Unique objects include capital construction objects, the design documentation of which contains at least one of the following parameters:

spans from 100 meters;
height from 100 meters;
consoles over 20 meters;
with partial or complete deepening of the underground part below the planning mark by 15 meters.
