On April 14, Decree No. 40 comes into force, which changes the rules for the transport of goods from abroad for citizens of Belarus.

"One of the norms established by the decree: a restriction on the import of goods up to 300 euros and 20 kg when moving a person across the border more than once every three months," said the deputy chairman of the State Customs Committee Vladimir Orlovsky.

What is now possible and what is not, we consider on the example of real situations.

In this case, new things can be brought back to the country for a total amount of 1,500 euros and weighing no more than 50 kilograms. Anything more will be subject to tax and duty. The customs officers will calculate the total cost according to cash receipts that you show them (don't throw away the receipts!). If there are no checks, customs officers will check the cost of things on their own. In practice, they often do this using the Internet on the websites of stores and shopping centers(Question: how long will it take?).

You can bring goods worth 1,500 euros once every three calendar months. That is, if you brought a TV set for 1,500 euros on April 15, then you can do it again without paying duties on July 1.

Situation 2. I have already been abroad once after April 14, brought a TV set for 1500 euros, and now I am going for the second time (earlier than in three calendar months) and from purchases I only have a phone for 299 euros. What will happen?

Nothing. Anything less than 300 euros is not subject to additional taxes and fees. Customs officers will determine the cost of your purchases in the same way as in the first case - by checks or on their own. Nuance - your purchases should not weigh more than 20 kg. If you buy something in Lithuania and plan to pick up Tax Free at the border, then ask the cashier for a copy of the receipt (the original will be taken along with the Tax Free papers).

Situation 3. I have already been abroad once after April 14, I brought a TV set for 1500 euros, and now I am going a second time (earlier than in three calendar months) and I am bringing a phone for 350 euros. What will happen?

If customs officers find your new phone, you will have to pay a customs fee for the entire cost of the phone, customs duty and value added tax. For each category of goods, the amounts of these payments are different. But in the end, they can even make up half the cost.

If you were carrying a phone for 299 and new jeans for 30, then you will have to pay for one thing to choose from. It is better to choose jeans.

Situation 4. I have already been abroad once after April 14, I did not bring anything, and now I am going for the second time (earlier than in three calendar months) and I am bringing a phone for 350 euros. What will happen?

The same as in situation No. 3. The fact is that customs does not care at all whether you carried something for the first time or did not carry it. Your legal 1500 euros are burned immediately after the first entry into the country. Even if you didn't buy anything at all.

Situation 5. I forgot that I have goods for more than the allowed amount and food (or I go) through the green corridor. What will happen?

- According to the innovations in Belarus, within a calendar month, without paying duties and taxes, it will be possible to receive postal items worth up to 22 euros and weighing up to 10 kilograms. In relation to goods, in terms of exceeding the specified norms, customs duties and taxes will be charged at the previously valid rate - 30% of the cost, but not less than 4 euros per kilogram. It will also be necessary to pay a customs fee of 5 euros, - Vladimir Nikolayevich noted.

For example, upon receipt of a parcel worth 50 euros and weighing 2 kilograms, customs duties and taxes will be calculated according to the following scheme: (50-22) * 30% = 8.4 euros + 5 euros (customs fee).

For reference: for the period from 2013-2015. the volume of imported international postal items increased by more than 6 times: in 2013, 1.9 million items were imported, in 2014 - 6.3 million, in 2015 - 11.8 million. Moreover, about 90% of the inhabitants of Belarus do not receive international mail. More than 250 thousand citizens receive from 10 to 100 international parcels per year. On average, about 10 international postal items come to one recipient, and about 15 to one address.

Goods for personal use… How much do we carry?


- The Decree clarified approaches to determining the destination of goods. Goods transported across the border more than once every three calendar months for an amount exceeding 300 euros and (or) weighing more than 20 kilograms will not be classified as goods for personal use. At the same time, the norms of duty-free import of goods for personal use in the amount of 1,500 euros and 50 kilograms continue to operate, - said Vladimir Nikolaevich Orlovsky, Deputy Chairman of the State Customs Committee of the Republic of Belarus.

He also explained that the provisions of Decree No. 40 do not apply to goods imported by air, exported earlier and imported back by individuals, imported by employees of diplomatic missions and employees of consular institutions and other international organizations, goods received as an inheritance, as well as imported during resettlement to a permanent place of residence in Belarus. In addition, the norms do not apply to used goods that were previously exported outside customs territory and imported back in an unchanged state without documentary evidence of their export, for example, mobile phones, laptops, etc., if their value does not exceed 1.5 thousand euros and 50 kg.

– When developing approaches to practical application norms of Decree No. 40, the interests of citizens are taken into account as much as possible. The decree was adopted to prevent attempts by citizens to move commercial parties under the guise of goods for personal use. We analyzed import norms in neighboring countries, the countries of the Eurasian Economic Union, the CIS, Canada and China. We looked at how international postal items (IGOs) go to Belarus. By the way, Belarusians mostly receive parcels (with purchases, gifts), which fit well into 10 kg and 22 euros. In addition, in a number of EU member states, for example, in Belgium, the Czech Republic, Italy, Finland, Slovakia, Germany and others, the rate of duty-free shipments is 22 euros. In Sweden and France, all IGOs, regardless of cost, are subject to VAT. By the way, in China this norm is 7 euros. Therefore, the reduction of the rate of duty-free import in our country is quite natural.

How will the customs authorities determine the value of what was sent from abroad and what payments will follow? P. Trubnik, Gomel.

The calculation is made based on the declared value of the IGO, which was indicated by the sender. If it is not available or it is incorrect, the inspector determines the cost according to the available price information for similar goods, as well as various online catalogs. If the limit of 22 euros and 10 kg is exceeded, the addressee will pay 30 percent of the excess amount (but not less than 4 euros per kg), as well as a fixed rate of 5 euros - customs duty. For example, for a parcel of 50 euros and weighing 2 kg, duties and taxes will be: (50 - 22) x30 percent. This is 8.4 euros. Plus 5 euros, we get 13.4. The Decree on this matter clearly defines: the import norms are applied from the date of registration of the parcel in the temporary storage warehouse. If the shipment arrived and was registered in the warehouse before April 14, then the previous provisions apply.

Upon returning, if you are in doubt whether you are complying with the norm or not, it is better to stand in the red channel and declare the goods, indicating the weight and value. If this is not your first trip in three months, but the value of the imported goods is more than 300 euros (or the weight is over 20 kg), then duty, VAT (20 percent) and customs clearance fee will be charged from the excess goods.

If citizens want to import duty-free goods for personal use, for example, household appliances more expensive than 300 euros, this can be done after three months from the date of the last trip. The limits of 1,500 euros and 50 kilograms remain the same.

Let's calculate: a person enters abroad for the second time in three months and carries a computer for 250 euros, a vacuum cleaner for 100. Or a washing machine for 250 euros and weighs 32 kg. How much will you have to pay at customs?

Consider the option: a computer and a vacuum cleaner. Insofar as total cost above 300 euros, then one product of the person’s choice must be declared with payment of customs duties. In this case, not a passenger ticket is served customs declaration and the goods declaration. In two months, when I go on vacation, I must take into account that purchases for personal use will include purchases of no more than 300 euros and no more than 20 kg. Unless, of course, I use air transport, to which the norms of the 40th Decree do not apply.

- How about a person who moves to Belarus?

Right. Since he is traveling for permanent residence, his luggage goes under the usual import rules, that is, without new restrictions. Of course, when a person submits a passenger declaration, he must have confirmation that he is moving to a permanent place of residence. Although each case is considered and controlled individually, because in certain situations a migrant simply does not have time to wait for permits.

Can customs officials offer to pay, for example, for used shoes, coats, perfumes, a phone or laptop that a traveler takes with him on a trip abroad? How to prove that it all just comes back home?

For used items that are imported back, worth up to 1,500 euros and weighing up to 50 kg, the provisions of the decree do not apply.

Are all issues related to the 40th Decree settled with all parties? Will there be any other innovations?
